1. Acceptance of Terms

By signing up and using FleetIT, you ("Customer") agree to abide by these Terms and Conditions. If you do not agree with any of these terms, please do not use the service.

2. Pricing

Toll Payment Fees

Customer will be charged the following amounts:

• A service fee charged monthly for all actively enrolled license plates. Service fees will be charged when a license plate is added for coverage for the first month, and at the end of each subsequent month for prior month usage.

  Service Fee Rates

  • First 10 vehicles: $9.99/month
  • Vehicles 11-50: $7.99/month
  • Vehicles 51 and above: $5.99/month
• The highest posted rate of tolls processed by FleetIT. Toll costs will be deducted from the account balance as they are received by FleetIT from the toll authorities.

Citation Payment Fees

For each citation submitted to FleetIT for payment, Customer will be charged the full amount of the citation, plus a $10 processing fee per citation. This fee applies to each citation submitted to FleetIT for payment.

3. Service Overview

FleetIT provides toll management services by paying toll charges on behalf of enrolled license plates. FleetIT also offers citation payment services for citations submitted by Customer for processing and payment, subject to the fees outlined in Section 2.

4. License and Access

• The service is available as a self-service, SaaS-based solution and may be used only for managing toll payments for enrolled vehicles.
• Customer agrees not to misuse or attempt to access any part of the service beyond the scope of these terms.

5. Term and Termination

• Indefinite Term: This agreement is indefinite and will remain in effect unless terminated by either party.
• Termination by Customer: Customer may terminate the service at any time by either closing their account or unenrolling all license plates.
• Termination by FleetIT: FleetIT reserves the right to suspend or terminate the Customer’s account for breach of terms, fraudulent activity, or at FleetIT’s discretion in cases of system abuse or non-payment.

6. Payment Terms

• Target Balance & Replenishment: The target balance is $20 per active license plate. When the account balance falls below the replenishment threshold, the payment method on file will be charged the amount needed to restore the full target balance.
• Deposit: Upon activation, Customer will be charged a deposit amount to reach the target balance.
• Auto-Replenishment: When the account balance falls below the replenishment threshold—defined as $10 per active license plate, an automatic replenishment will be triggered. The payment method on file will be charged the amount required to bring the balance back up to the target balance of $20 per active license plate.
• Failed Replenishment and Account Termination: If a replenishment charge fails and the account balance falls below the termination threshold—defined as $5 per active license plate—the account will be terminated and all plates will be unenrolled. Any remaining balance will be refunded to the payment method on file within 30 days, minus any outstanding tolls or fees deducted from the account.
• Credit Card Convenience Fee: For all payments made by credit card, a convenience fee of 3% will be added to the total amount due. This fee covers the cost incurred from credit card processing and is not greater than our cost to accept such payments.

7. Customer Responsibilities

• Customer agrees to provide accurate and up-to-date license plate information.
• Customer is responsible for updating plate information in case of vehicle changes, sales, or disposals.
• Customer agrees to maintain an active payment method to cover toll payments as they occur.

8. Limitations of Liability

• FleetIT, LLC is not liable for any indirect, incidental, or consequential damages, including loss of profit or data, resulting from the use of the service.
• The service does not guarantee uninterrupted access to toll systems and is not liable for any toll-related fines or violations outside of its control.

9. Governing Law

This agreement shall be governed by the laws of the State of New York.

10. Changes to Terms

FleetIT, LLC reserves the right to update or modify these terms at any time. Continued use of the service after any changes constitutes acceptance of the new terms.

11. Consent

By clicking “I Agree” and using the service, Customer acknowledges that they have read, understood, and agree to these Terms and Conditions.
